TERMS AND CONDITONS OF SALE

Buyer

  • The bidder must register to participate in the auction; any bid made without proper registration will be invalid.
  • V and P Auctions reserve the right to refuse participation, without the necessity of furnishing any reasons.
  • All bids will attract a 15% buyer’s commission. Please take this into consideration when bidding.

In general, there are no reserve prices on most goods sold. Only several lots will be sold subject to confirmation (STC), the auctioneer will announce which lots are sold STC as they come up for sale.

SUBJECT TO CONFIRMATION – “STC” means that the owner has to accept or reject the bid after finalization of the auction the seller has two business days to accept or reject the offer. No bid may be withdrawn after the fall of the hammer until the expiry of the confirmation period. During this time the offer shall be open for acceptance by the seller and if the offer is accepted, the sale shall be deemed to be a sale by auction. – In this case it will be mentioned in the description of the lot.

  • All items are sold “voetstoots”, “as is”, “where is” without any guarantees or warranties given by V and P Auctions or the seller. The purchaser shall be deemed to have thoroughly examined the items and have accepted the condition and state thereof.
  • Vand P Auctions shall not be liable for any minor errors in description of any items.
  • All goods may be viewed two days before the commencing of the auction date from 10h00 to 16h00 - Please do not mix the lot numbers or open the boxes while viewing the goods and do not remove the stickers from the lots as it makes our work difficult and takes time to resolve.
  • No goods will be released to buyers who paid by EFT until payment is reflected in our account. No lots or part of lots will be allowed to leave the auction site without the assistance of our staff and the proof that the invoice is paid in full. All invoices must be paid in full within two hours after the auction ends. No exceptions will be made. When purchasing television sets, please present a valid TV license. There will be no dispatching of goods during the auction sale. No exceptions will be made. The auctioneer is not responsible to load the goods purchased. All goods purchased must be removed from the auction site no later than Friday 12h00.
  • The purchaser shall remove his purchases no later than Friday 12h00 after the conclusion of the auction, and only after full clearance of his payment as set out in the invoice has been affected. After 7 days, a storage charge of R30 per day will be charged. Goods not collected within 30 days, will be resold to cover storage cost.
  • The auctioneer shall have the right to control, regulate and record the auction. The recording of the auction shall be prima facie evidence of the auction proceedings, both the bidders’ record and the vendor roll are available for inspection during normal business hours free of charge after the auction has been concluded.
  • The auctioneer may accept or reject bids in his sole discretion without providing reasons. This would include rejecting an offer previously accepted by the auctioneer. In the event of a dispute between bidders, the auctioneer will have the discretion to put the lot up for auction, again and his decision shall be final and binding. The auctioneer may, without penalty or prior notice, withdraw any item on auction at any time before the sale thereof or during the auction. The auctioneer will reserve the right to extend bidding time, should last minute bidding wars occur.

We are conducting our auctions in a fair manner towards buyers and sellers. We do not have planted bidders in the crowd and do not accept bids from imaginary cell phone bidders’ pillars or flies on the walls. We expect the same honest behavior from our bidders. Therefore, no ring practice is allowed. A ring practice is a criminal offense. When a few bidders club not to bid against each other in order to get the goods at a lower price. This practice is illegal and called bid rigging and is not fair towards the seller. Such practice will not be tolerated. Therefore, if and when the auctioneer is aware of such practice, he has the right to withdraw the goods from the auction and ban the violators from participating in further sales within our auction network.

  • Intimidation of fellow bidders is forbidden. Intimidators will be asked to leave and will be banned from attending further sales.
  • The auctioneer is entitled to correct any bona fide error in the conduct or conclusion of any sale or arising from any incorrect information to the items for sale. If the error is capable of not being corrected, then the auction shall be deemed not having taken place and no party at the auction will have any claims against the auctioneer or the seller arising from the cancellation of the auction.
  • A sale by auction is complete when the auctioneer announces its completion by the fall of the hammer, or any other customary manner.
  • Risk on each item passes on to the purchaser on the fall of the hammer of a successful bid once a particular lot closes, even though upliftment / delivery has not yet taken place.
  • It is the buyer's responsibility to look after his purchase as the auctioneer is not responsible for any loss or damage to goods after knocked to the buyer. It is the buyer's responsibility to dismantle and disconnect all his purchases without causing damage to seller's property. The purchaser shall bear the risk of items remaining at V and P Auctions premises, for any shortages or damage which may occur.
  • When collecting your purchase, please do not leave anything behind at the auction site. When lots or part of lots are not collected, the auctioneer reserves the right to remove the above-mentioned items from the auction site at the buyer's expense.
